A declaration of martial law only means that the military, in SOME instances, can be used as a policing agency and that SOME civil rights can be only temporarily curbed or suspended for the duration that Congress allows for the declaration. Martial law does NOT mean that the President is given a free pass to do as he wishes with absolutely no oversight.
