Doesn’t "the facts were being fixed around the policy" just mean "the facts around the policy were being *determined*?" "Fixed" can mean "manufactured", "altered", or "tampered with". It can also mean "verified", "set", or "evaluated." If the person behind the memo actually had evidence that facts were being manufactured, he would have been quite a bit more explicit in his report.
