Palace Attempts To ’Spin’ Kate As A Victim

This morning, a lawyer for the Royal couple will a lodge a criminal complaint in France over topless pictures of Kate published in the French magazine, Closer.

A palace spokeswoman said: "We can confirm that a criminal complaint is to be made to the French Prosecution Department.

Closer is also the subject of a civil case "The complaint concerns the taking of photographs of the Duke and Duchess of Cambridge whilst on holiday and the publication of those photographs in breach of their privacy."

But IF a woman went into her back garden in the UK and removed her top and IF a member of the public was able to see her and IF that person felt offended and a complaint was filed, the woman might face criminal prosecution.

In England and Wales, the offence of "indecent exposure" and other sexual offences were replaced by the more specific and explicit Sexual Offences Act 2003. In fact, committing an offence outside the UK that would be an offence in the UK may also be prosecuted, so all it would take is for someone in France to go down to the local police and file a complaint indicating that they were offended or alarmed by the Duchess of Cambridge’s breasts being exposed—which is not very likely.

But a victim, Kate Middleton is not (except perhaps in that she’s a victim her own naivety).

Their planned legal action in France will be debated and may have to be expanded into Italy and Ireland to be taken seriously—all the while the value of those photos is being driven up by the Royal’s insistance that Kate had some right to expose her breasts in public.
