In effect, Bush is asserting the powers that accrued to Hitler in 1933. His Federalist Society apologists and Department of Justice appointees claim that President Bush has the same power to interpret the Constitution as the Supreme Court. An Alito Court is likely to agree with this false claim.

Dictatorships seldom appear full-fledged but emerge piecemeal. When Julius Caesar crossed the Rubicon with one Roman legion he broke the tradition that protected the civilian government from victorious generals and launched the transformation of the Roman Republic into the Roman Empire. Fearing that Caesar would become a king, the Senate assassinated him. From the civil wars that followed, Caesar’s grandnephew, Octavian, emerged as the first Roman emperor, Caesar Augustus.

Two thousand years later in Germany, Adolf Hitler’s rise to dictator from his appointment as chancellor was rapid. Hitler used the Reichstag fire to create an atmosphere of crisis. Both the judicial and legislative branches of government collapsed, and Hitler’s decrees became law. The Decree for the Protection of People and State (Feb. 28, 1933) suspended guarantees of personal liberty and permitted arrest and incarceration without trial. The Enabling Act (March 23, 1933) transferred legislative power to Hitler, permitting him to decree laws, laws moreover that "may deviate from the Constitution."

The dictatorship of the Roman emperors was not based on an ideology. The Nazis had an ideology of sorts, but Hitler’s dictatorship was largely personal and agenda-based. The dictatorship that emerged from the Bolshevik Revolution was based in ideology. Lenin declared that the Communist Party’s dictatorship over the Russian people rests "directly on force, not limited by anything, not restricted by any laws, nor any absolute rules." Stalin’s dictatorship over the Communist Party was based on coercion alone, unrestrained by any limitations or inhibitions.

In this first decade of the 21st century, the United States regards itself as a land of democracy and civil liberty but, in fact, is an incipient dictatorship. Ideology plays only a limited role in the emerging dictatorship. The demise of American democracy is largely the result of historical developments.

Lincoln was the first American tyrant. Lincoln justified his tyranny in the name of preserving the Union. His extralegal, extra-constitutional methods were tolerated in order to suppress Northern opposition to Lincoln’s war against the Southern secession.

The first major lasting assault on the U.S. Constitution’s separation of powers, which is the basis for our political system, came with the response of the Roosevelt administration to the crisis of the Great Depression. The New Deal resulted in Congress delegating its legislative powers to the executive branch. Today when Congress passes a statute, it is little more than an authorization for an executive agency to make the law by writing the regulations that implement it.

Prior to the New Deal, legislation was tightly written to minimize any executive branch interpretation. Only in this way can law be accountable to the people. If the executive branch that enforces the law also writes the law, "all legislative powers" are no longer vested in elected representatives in Congress. The Constitution is violated, and the separation of powers is breached.

The principle that power delegated to Congress by the people cannot be delegated by Congress to the executive branch is the mainstay of our political system. Until President Roosevelt overturned this principle by threatening to pack the Supreme Court, the executive branch had no role in interpreting the law. As Justice John Marshall Harlan wrote: "That Congress cannot delegate legislative power to the president is a principle universally recognized as vital to the integrity and maintenance of the system of government ordained by the Constitution."

Despite seven decades of an imperial presidency that has risen from the New Deal’s breach of the separation of powers, Republican attorneys, who constitute the membership of the quarter-century-old Federalist Society, the candidate group for Republican nominees to federal judgeships, write tracts about the Imperial Congress and the Imperial Judiciary that are briefs for concentrating more power in the executive. Federalist Society members pretend that Congress and the judiciary have stolen all the power and run away with it.

The Republican interest in strengthening executive power has its origin in agenda frustration from the constraints placed on Republican administrations by Democratic congresses. The thrust to enlarge the president’s powers predates the Bush administration but is being furthered to a dangerous extent during Bush’s second term. The confirmation of Bush’s nominee, Samuel Alito, a member of the Federalist Society, to the Supreme Court will provide five votes in favor of enlarged presidential powers.

President Bush has used "signing statements" hundreds of times to vitiate the meaning of statutes passed by Congress. In effect, Bush is vetoing the bills he signs into law by asserting unilateral authority as commander in chief to bypass or set aside the laws he signs. For example, Bush has asserted that he has the power to ignore the McCain amendment against torture, to ignore the law that requires a warrant to spy on Americans, to ignore the prohibition against indefinite detention without charges or trial, and to ignore the Geneva Conventions to which the U.S. is signatory.

Bush Justice Department official and Berkeley law professor John Yoo argues that no law can restrict the president in his role as commander in chief. Thus, once the president is at war - even a vague, open-ended "war on terror" - Bush’s Justice Department says the president is free to undertake any action in pursuit of war, including the torture of children and the indefinite detention of American citizens.

The commander in chief role is probably sufficiently elastic to expand to any crisis, whether real or fabricated. Thus has the U.S. arrived at the verge of dictatorship.

This development has little to do with Bush, who is unlikely to be aware that the Constitution is experiencing its final rending on his watch. America’s descent into dictatorship is the result of historical developments and of old political battles dating back to President Nixon being driven from office by a Democratic Congress.

There is today no constitutional party. Both political parties, most constitutional lawyers, and the bar associations are willing to set aside the Constitution whenever it interferes with their agendas. Americans have forgotten the prerequisites for freedom, and those pursuing power have forgotten what it means when it falls into other hands. Americans are very close to losing their constitutional system and civil liberties. It is paradoxical that American democracy is the likely casualty of a "war on terror" that is being justified in the name of the expansion of democracy.

  • To late. The American attitude toward politics is dangerous. Not only preemptive wars are accepted but also a one party system, which now will never go away. Moreover the Democrats will continue. There is practically only one alternative in America the Greens. Independent candidats have turned out even worse.

  • Good article. A regular contributor to Bellaciao, David R. Hoffman, Legal Editor of Pravda.Ru actually wrote a two-part article about the similiarities between Bush and Hitler way back in 2003. It was entitled Bush vs. Hitler and Bush vs. Hitler, Part II. You probably still can find it on Pravda’s site, with their search engine. The article was criticized, naturally, because back then the American public was treating Bush like some sort of demigod. Sort of proves how blind and ignorant people can be. What a difference three years have made. Too bad the idiots who voted for Bush in 2004 didn’t wake up before now. But nobody can say they weren’t warned of the evil they were placing into power.

    • Since when did the American people actually vote that Nazi into office? He stole that election, like the one in 2000. We have to be carefull to keep the blame where it belongs, on the criminals in the US government (democrat and republican alike) who have sold out our constitution and the rights and freedoms of the people. I’m not saying Bush doesn’t have SOME American supporters, (something around 20%, which is laughable considering how much money they put into propogandizing us, chumps). But, those same Bush supporters are so propogandized and brain washed and paralyzed with manipulated fear, that it defies culpability. Target the shepherd, not the sheep.

    • I agree that the American people did not vote Bush into office in 2000. I was talking about 2004. I also suspect there was probably something suspicious about that election as well. The problem was, there were enough people that voted for that idiot Bush to at least make it look like a fair election, even though the corruption in Ohio clearly shows it wasn’t. Bush had more supporters back then than he does now. So I do blame the sheep. After all, if sheep have their eyes open to the future, they won’t be turned into lamb chops. Many of the sheep that voted for Bush are now regretting it—far too late. Damn them to hell for being too stupid to recognize the evil he represented in the first place.

      In 2004 for example you had Skull & Bones members Bush and Kerry along with Ralph Nader, who just happened to have as his advisor a Skull & Bones member. Three parties who all had Skull & Bones candidates. Forget the electronic voting machines that were rigged, this is the real issue. Private organizations that control congress, the senate and all the political parties and their candidates. CFR, Trilateral Commission, Bilderbergers, Zionists, Masons, Bohemian Grovers etc. etc. You can’t have free and honest elections when the entire system top to bottom is corrupt.

    In point of historical fact, it was actually the Roman general and dictator, Lucius Cornelius Sulla (138bc-78bc), who set the precedent for the eventual destruction of the republic - that the more famous Julius Caesar later followed and accomplished - by marching through the gates of Rome with his legions not once but twice.

    Historical accuracy notwithstanding, Dubya’s relentless attacks on the nation’s democratic institutions, if left unchecked, will surely provide a firm foundation upon which some future American Caesar will finish the job and utterly destroy what will be left of the republic.

    There is now talk of a possible run for the presidency by Jeb Bush in the next election. If this horrific possibility should live to fruition, he will surely finish what his older brother and father had labored for so mightily. Lest we forget, in 1997, Jeb Bush was a signatory to the Statement of Principles of The Project for The New American Century.

  • Other question: are Americans guilty, because they let the Bush dictator do whatever he wants. 1.8 million Afghanis and 1.1 million Iraqis are dead since the "war on terror" begun. Also the existence of concentration camps in Guantanamo Bay and they build another one in Bagdad, which is the world biggest ever build concentration camp.
    But all we hear: ...we are in support of the troops and we are proud of our veterans.

    Guilty in the the same sense as we learned in Nuremberg.

    One important prerequisite for freedom is an educated and aware populace. For whatever reason, American society seems more driven by pleasure than by the goals of education, sacrifice, and deferred gratification. Give us more television, more shopping malls, more football, more music, more parties, bread and circuses. A polity whose members refuse to exercise self-control in their own lives will welcome with cheers, singing and applause the strongman ruler who will inevitably rise to force self control and discipline upon them.

    On a different note, it is well and good and important to address America’s failings. There is no shortage of commentators doing so. Indeed, from this website and many others one would draw the conclusion that the focus of evil in today’s world is the U.S.A. No one less than Noam Chomsky has said as much on multiple occasions.

    Yet, I ask myself if this is the result of clearsighted judgement and balanced perspective. Is it really true tha America has lost her moral bearings and descended to a level worse than that of any other nation on the planet? Does America deserve to be destroyed and rebuilt, with all the suffering that would entail? Does America have any external enemies who yearn to do the "destroying" part of that equation? Would they let the surviving Americans do the rebuilding, or would they take them for prison labor camps, or would they leave no prisoners?

    A friend of mine put it this way: you know that the Military-Industrial Complex is always plotting to rob you of your wealth and your liberty, if not your very life. But Russia or China - why would they lie to us? What possible gain could they receive from misleading us? Are we wise to belive that the governments of the other superpowers have the best interests of Americans at heart?

  • I enjoyed reading this article plus the posts, thanks. There’s a great deal of truth with all of this, however there still is more that needs to surface and be considered. Hopefully what’s around the corner will do a better job with waking up America?

    Stealing the election is exactly what happened. They also ruined my office network system, destroyed many computer devices and much more, because I know too much about them. Their technical skills are very good and more involved in other areas which many don’t know about. Little by little though, this area is being shut down, so there’s hope. The Internet is still in it’s infancy, technically speaking, and security wasn’t well planned, but now it’s getting better. Electronic voting now will have to measure up and prove it’s as good as it is from now on. It really takes all of us to wake up and take notice to change thigs around. There will be other issues hopefully not as horrible as these past ones were, but if they surface we need to do what we can to put an end to them.

    Thank God enough has surfaced with electronic voting to illuminate the reality of what really happened so our next election will run differently. But from what I know, that is only a smal part of what still needs to surface. We have a system of Government, like it or not! If it’s broken, then lets fix what’s broken when it shows itself to be broken. By not fixing the broken parts, we encourage a slide in the wrong direction, like now. The system is huge and often betrays itself too, this also needs to be fixed as well. I know part of the problem to be a criminal element within our Government which for each 10 involved, 3 are Democrats and 7 are Republicans. This may be one reason why the two parties appear to not work as they should, but seem to scheme together instead. I was a Republican but have changed to an active Democrat. I accept that the Dems need a good house cleaning and in my opinion, they will have a better opportunity to succeed towards winning against the Republicans to change things around, than smaller parties. Unfortunately, when you look at counting votes, it’s a game of numbers and the one with the highest count wins. But right now, we can’t afford to let the Republicans win as if that happens, we certainly will loose everything!

    I was in a family for more than 26 years who is part of the criminal system. Believe me, the worst has yet to surface! There are far worse crimes committed to US Citizens on US soil then ever and this you’ll learn is similar to what happened with the Nazi’s. Also, the criminal element brags about being "The Wrold’s Largest Criminal System" and for good reason, they extend beyond our boarders. If you look around, it’s clear something else is happening elsewhere.

    There’s a reason for "the push towards a Dictatorship". It’s not only because of a typical and common progress move forward, but more from a well planned interest to make it happen! It’s been in the mill for a few hundred years and this too will surface soon as well. Some evidence of this can be seen on the back of a US Dollar Bill. Yes, it’s there for all to see and goes back hundreds of years. This problem starts with Secret Societies that linked with those in Public Office. Freemasons, Illuminati’s, Tri-Lateral Commission, Le Cercle, Skull & Bones, Bilderbergs, just to name a few. At one time, some of these secret societies may have served people well but that may prove not be the case anymore. Be patient as there still is much more to surface.

    Hitler then passed the enableing Act 1933 = Bush then passed the Patriot Act to strip Americans of there civil rights.   • Getting rid of Bush won’t solve the problems, unless his replacement is someone other than the bought-and-paid-for stooges working for the international bankers who control the US and world economy. Hitler was backed in a significant way by Bush’s grandfather Prescott Bush, working for the Union Bank of New York. It’s a well documented fact that Wall Street backed the Bolshevik Revolution as well as the rise of Hitler. The world’s bankers are still funding wars and tyranny, including Bush’s domestic tyranny and mass murdering foreign policy. The American army is being destroyed with DU; martial law is on the horizon as the American economy is ready to implode, and the international bankers are continuing to benefit. It doesn’t matter who’s in power, even if Bush is ousted, as long as the new leader of the US is bought and paid for by the international money men and power brokers.     • You are so right, it all boils down to who controls the fake money.

      Once they did away with the gold standard, their way was clear, money controls all.
      Every Country that is on the outs with this administration wants their own money
      system and trade agreements, not what is being shoved down their
      throats by Bush and the CFR. It would not have made any difference who
      had got elected, both were members of the Skull and Bones, which is a branch of
      the Illuminati along with and including the CFR.

      The democrats and republicans are working together, both are pushing for Amnesty
      notice how the D and R are co-sponsoring legislation together now?

      They are not asking for Impeachment, even tho they know Bush is doing wrong,
      they are hiding the facts of Jeffery’s bribe taking, because the rot runs thro the
      Republican party also.

      Even if you do not agree on all their platform, the Constitution Party is our only
      hope, other wise kiss America good bye. A person will have to look for some one
      running other than a D or R, or with a platform that stands for the ordinary
      person, not the rich.

      I have always figured the reason John Kennedy was assassinated was because
      he wanted to put the country back on the gold standard.
